TikTok Faces Ban by Sunday After Supreme Court Rejects Appeal

by Jonathan Feb 27,2025

The Supreme Court's rejection of TikTok's appeal paves the way for a potential ban on the platform, effective Sunday, January 19th. The court unanimously dismissed TikTok's First Amendment challenge, citing the app's scale, vulnerability to foreign influence, and extensive data collection as justifications for government intervention on national security grounds.

Absent political intervention, TikTok faces a complete shutdown on Sunday. While President Biden has expressed a preference for TikTok's continued operation under American ownership, the implementation of any potential ban falls to the incoming Trump administration.

The Supreme Court's ruling explicitly acknowledged TikTok's significance for its users but emphasized Congress's determination that divestiture is necessary to address national security concerns.

Despite previous opposition to a TikTok ban, President-elect Trump may issue an executive order delaying enforcement for 60-90 days. Reports suggest he is engaging in discussions with Chinese officials regarding the matter. The possibility of a complete sale to a Western entity remains uncertain, although reports suggest this is being considered. Elon Musk, with his ties to the incoming administration, is reportedly involved in facilitating potential acquisitions, possibly acting as an intermediary or even a buyer himself.

In anticipation of a ban, users have migrated to alternative platforms, with Red Note (Xiaohongshu) experiencing a significant surge in new users.

TikTok's future in the U.S. hinges on a successful sale or a last-minute executive order from the Trump administration.
